ZVAB vs. Amazon: What actually makes the price parity clause?

beginning of last year, Amazon announced the introduction of a so-called price parity clause. It prohibits the Amazon vendors, their products (the Internet) elsewhere, lower fares. Amazon defines the following: "price parity is generally that your offer for every single article that you offer on Amazon.de, is at least as favorable as the cheapest of all the offers to which you offer this article on your other non-retail store-based distribution channels. "

The relevant terms and conditions clauses are applicable as from 01 May 2010. The Central Directory of Antiquarian Books (ZVAB) took action against the use of the clause for books and persuaded the district court Munich I for an injunction against Amazon (Az 37 0 7636/10 v. 22.04.2010). On 10.21.2010 the contradiction Amazons took place through a hearing. The sentence was announced for 23/12/2010.

This is not given and so it is for now still in Amazon: "The price parity does not apply to the supply of books on Amazon.de."

ZVAB when I asked about the status of proceedings and was told that the decision not was spoken, since the parties' lead-court talks. There are so out settlement negotiations. If the answer is not clear letzinstanzlich because of a "successful" conclusion of negotiations, this would be a pity, because many are waiting on Amazon dealer. A defeat would probably mean the end of Amazons of the clause, as the situation comparable to other product categories be expected.
